Terms and Conditions
This Agreement (the "Agreement") governs the use of the Chargo app ("Chargo" or "the App”). The parties to the Agreement are you as a user of Chargo (" you" or "yours") and Chargo AS with organization number 9230 742 778 ("the Company", "we", "our" or "us").
You accept the Agreement by creating a user profile in the App. The terms also apply to the use of our website as far as it is appropriate.
Terms are subject to change. If change occurs to terms that are of importance to you, you will be notified before the change takes effect, so you can decide whether you want to continue using Chargo subject to the new terms.
We want to offer the best possible service that is tailored to the needs of the users. Chargo is therefore constantly evolving in terms of appearance, functionality and content. We will make sure to keep you informed about changes and new opportunities.
In order to unlock a powerbank and use it to charge your mobile device, you must register a user account in the App. You can only register one user account, and you must ensure that all information about you as a user is accurate and up to date at all times.
The age limit for using Chargo is 13 years.
Chargo is for your personal use only, unless otherwise agreed in writing with us. You must not allow others to use our services through your user account, and you must ensure that others do not have access to login information to your user account. If you become aware of any unauthorized use of your user account, you must notify us immediately so that the user account is blocked. You are fully responsible for all use of Chargo through your User Account until your User Account is deactivated or blocked.
When using a power bank, you must perform a basic check of the unit and the supplied cables to ensure that these are not visible damage and that the unit has sufficient battery capacity. This is done by shaking the device and checking the battery light indicator. You should also regularly check that the power bank is functioning properly and has sufficient battery capacity throughout the rental period, so that you can benefit from our service as much as possible.
If you notice any errors or damage to the power bank or the cables, do not use it and you must notify us immediately through the App or by contacting our customer service: support@chargo.io. The same applies if other problems arise when using our services.
"You must treat Chargos equipment with care and as if it were your own. The equipment must be returned in the same condition as it was at collection. We reserve the right to claim compensation for damage beyond normal wear and tear according to the current price list, cf. clause 7.1."
The rental period starts by scanning the QR code at the charging station and accepting pricing in the App or browser to unlock the power bank. If you become aware of damage, lack of battery capacity or other problems, do not use the power bank and notify us as soon as possible, cf. section 3.3.
The rental period lasts from activation until the power bank is returned in accordance with this point. Return of the power bank is done by placing the power bank back in a free slot in the charging station and checking that the power bank is locked. You will then receive confirmation in the App, or browser that the rental has ended.
A Chargo Subscription is active from the time you sign the subscription in the app. You can rent Chargo Power Banks as many times as you like while the subscription is active. You can cancel the subscription at any time in the app.
If the power bank is lost, damaged or for any other reason it is not possible to return the power bank in accordance with clauses 3.4 and 4.2 before the expiry of the maximum rental period, your debit card will be charged according to the current price list for the rental period and the replacement of the power bank.
See current price list under Pricing in the Chargo app, or browser. Chargo Subscriptions are automatically renewed every month until cancelled by the user in the app.
If you wish to keep the power bank after use, you may not return the power bank as required by point 4.2. In that case, you will be charged for the power bank according to the current price list at the end of the maximum rental period. See the price list for more information. Price per minute during the rental period counts as well.
If there is no cover on the debit/credit card registered in the App, and/or the user does not pay for any outstadning rental amount, we reserve the right to suspend further use of our services until payment has been made. In such cases, we may also have to claim missing payment(s) through invoice. In that case, an invoice and administration fee of NOK 125 will be charged.
We process your personal information in accordance with Norwegian privacy law. We will not share your personal information with others, but please note that we use certain subcontractors to provide our services to you. Such subcontractors are not permitted to use personal information for anything other than providing our services to you
You choose whether you want to give the App access to your camera to register QR codes, position to find the nearest charging box, access to read battery level on mobile or contact list to invite friends. We refer to our privacy statement for further information on how we process your personal information.
We will sometimes send you information about Chargo, such as tips on using the service, news, statistics and other relevant information. If you have received discount codes from us, these can be used in accordance with the rules stated in connection with the issue of the discount codes
Sometimes we will offer promotional campaigns where you will receive discount codes for you and the persons you recruit. Referral functionality should only be used for this purpose and in accordance with any specified guidelines. We reserve the right to cancel discount codes for abuse of this scheme.
We reserve the right to block your user account and / or access to our services if we have reason to believe that these Terms of Use have been violated, attempts to misuse the Services, or other harmful or illegal behavior.
All rights and all material related to Chargo, including trademarks, program code, text, images and other belong to Chargo AS or its licensors. If you wish to use such rights or material beyond what is stated in the Agreement, you must first ask for our written approva
We do our best to make our power banks and services available to you at all times. However, we cannot guarantee that the services will be available, for example due to high demand or unforeseen technical problems. We will try to provide information about any limitations on availability, but cannot be held responsible for any losses or other consequences as a result of Chargo not being used as intended.
If there are deficiencies in our services, for example that you have not been charged with your mobile phone as a result of the power bank being defective, you will be entitled to compensation as long as this is not due to you or circumstances on your part. Compensation is initially given in the form of discount codes that can be activated through the App. The right to such compensation or other compensation does not apply as long as we can prove that the defect is due to an obstacle beyond our control that we could  not reasonably expect to have taken into account at the time of the agreement or to avoid or overcome the consequences.
In accordance with the Product Liability Act (Produktansvarloven), you may in certain cases be entitled to compensation if our products cause damage to a person or a thing. Beyond this and the liability as mentioned in clause 11.2, we disclaim any liability to the extent permitted by applicable law. Indirect losses, including lost profits, depreciation, loss of data and other consequential damages or any loss in connection with business activities, are not compensated.
As the service begins with your expressed prior consent, you will not have a statuatory cancellation right for the purchase.
The agreement is valid as long as we offer Chargo. We may terminate the Agreement with immediate effect if we have reason to believe that you are acting in breach of any provision of the Agreement or otherwise are abusing Chargo. The same applies if you have not used our services for the past 24 months. You may terminate this Agreement at any time by contacting us at support@chargo.io.
If we can not charge you for the renewal of your Chargo Subscription within five days of the end of the subscription period your subscription will be automatically terminated. If you have an active rental at the time of the cancellation, you will be charged a 299,- lost fee for the power bank.
There is a fourteen days withdrawl period when you sign up for a Chargo Subscription. If you would like to use the right to withdraw from the subscription you must contact us at support@chargo.io.
Chargo has no signup fees, or binding time when you sign up for a subscription. You may terminate your Chargo Subscription agreement at any time in the app, or by contacting us at support@chargo.io, but minimum 48 hours before the subscription end. If you cancel the subscription within two days of the end of the subscription period you will automatically charged be for another period.

We may assign this Agreement in whole or in part, including your customer relationship, without your consent. The Agreement is governed by Norwegian law. Any disputes that are not resolved amicably will be settled by Norwegian courts.
